During the second half of the twentieth century processes of urbanization and accelerated construction have shaped the present reality of a large part of the built heritage of our country. These major processes of urbanization have created environments that are built to the reasonable satisfaction of most basic needs of the Spanish population. However, the vast amount of new buildings built in recent years and decades has not always achieved a quality parameters suited to the demands of citizens. Indeed, the Spanish society, as in neighboring countries, increasingly demand quality in buildings and urban spaces.
This demand for a higher quality of the building responds to a more demanding conception of what it means to the quality of life for all citizens on the use of the built environment. It also meets a new requirement for the sustainability of processes and developers Building on its three environmental, social and economic. The process of building, by its direct impact on the configuration of living spaces, implies a commitment to functionality, economy, environmental harmony and balance, of obvious importance from the standpoint of general interest and, therefore, policies government. The building sector is also one of the main economic sectors with significant impact on the wider society and the values involved in cultural and environmental heritage.
With the objective of improving the quality of the building, and promoting innovation and sustainability, the Government approved the Technical Building Code. It is a policy instrument which establishes the basic requirements of quality of buildings and facilities. Through this legislation is to the satisfaction of certain basic requirements related to building safety and welfare of people, referring to both the structural safety and fire protection and sanitation, protection against noise, energy efficiency or accessibility for people with reduced mobility.
On the one hand, the adoption of the Technical Building Code means the excess and modernization of the existing regulatory framework of the building in Spain, regulated by Royal Decree 1650/1977 of June 10, on the building regulations, which established the Basic Rules of Construction, such as mandatory provisions in the design and execution of the buildings. Within this framework, adopted a number of Standards since 1979, have opened up a set of rules which has been meeting the diverse demands of society, but that has not come to constitute in itself a coordinated set, as a Technical Building Code, similar to those in other advanced countries, on the other hand, the Technical Building Code establishes a regulatory framework comparable to that existing in developed countries and harmonize existing national regulations in the building with provisions of the European Union force in this area.

Royal Decree 1675/2008, of October 17, amending the Royal Decree 1371/2007, of October 19, approved by the Basic Document 'DB-HR protection against noise "of the Technical Code Building and modifying the Royal Decree 314/2006 of March 17, approved by the Technical Building Code.

Royal Decree 1371/2007, of October 19, approved by the Basic Document 'DB-HR Protection against noise, the Technical Building Code, and amending the Royal Decree 314/2006 of March 17 by approving the Technical Building Code, provides in its third transitional arrangement, during the 12 months after the entry into force of this Royal Decree may apply the basic requirements developed in the Basic Document 'DB-HR protection against noise "of the CTE, without prejudice to the final disposition on the third entry into force of the said royal decree.
He noted that after that period, shall be compulsory application of the basic requirements developed in the core document 'HR-DB Protection against noise, which approves of the CTE.
In this way, and at the scheduled date for its entry into force, which occurred on October 24, 2007, the completion of the transitional period will take place on October 24, 2008, by which time would be mandatory requirements developed in the basic core document 'HR-DB Protection against noise, the CTE was adopted by Royal Decree 1371/2007.
In this connection, the second transitional provision of Royal Decree 1371/2007 on the arrangements for applying the previous rules to the core document 'HR-DB Protection against noise, the CTE, which allowed for the twelve months following the entry into force of Royal Decree, may continue to apply after the rules in this area is quoted in it, and that during this transitional period may choose to apply the basic rule or above the basic requirements developed in the Basic Document 'DB HR-Protection against noise, the CTE is approved by royal decree.
This period of voluntary implementation of the rule has proven to be important and essential to their assimilation by the agents who have to implement, given the technical complexity of the rule, as recognized by the entire sector. Also this period is serving sectors to be prepared in such key areas as training of technicians and characterization of the acoustic performance of products and technical solutions that ensure the effective implementation of the standard.
In this regard, the Administration has made an effort to help the industry by providing a training plan on the noise standard, and made a first version of the catalog of construction elements, characterized by its acoustic performance and otherwise, and also developing a tool to help facilitate its proper implementation.
All these efforts, including training, have been developed in the period of voluntary compliance under the rule is changed, which has been shown to fall short in relation to the effort required by this rule in special technical complexity. Therefore, in order to complete the training efforts and improvement of tools and construction elements of the catalog, it seems appropriate to extend for six months over the period of voluntary implementation.
In the handling of this Decree have been complied with procedures established by Law 50/1997, of November 27, Government, having been informed by the Ministry of Public Administration, pursuant to Article 24.3. Also, a report has been submitted by the Commission of the Technical Building Code, Council for Sustainability, Quality and Innovation in Building, pursuant to Article 2 of Royal Decree 315/2006 of March 17 by establishing the Council for Sustainability, Innovation and Quality of Construction.
By virtue of a proposal from the Minister of Housing, in accordance with the Council of State and after deliberation by the Council of Ministers at its meeting on October 17, 2008 were agreed:

Royal Decree 1371/2007, of October 19, approved by the Basic Document 'DB-HR protection against noise "of the Technical Building Code, and amending the Royal Decree 314/2006 of March 17, approved by the Technical Building Code, is amended as follows:
One of the first paragraph the second transitional provision reads as follows:
"Until April 24, 2009, may continue to apply Royal Decree 1909/1981, of July 24, which adopted the basic rule of building NBE CA-81 on acoustics in buildings, as amended by Royal Decree 2115/1982, of August 12, becoming known as NBE CA-82, and revised by Order of September 29, 1988 and renamed NBE CA-88, subject to repeal the provision expressly revoking this unique Royal Decree. "
Two. The first paragraph of the third transitional provision reads as follows:
"Until April 24, 2009 may apply the basic requirements developed in the Basic Document 'DB-HR protection against noise" of the CTE, without prejudice to the final quarter of this royal decree on its entry into force. "
First final provision. Title Companies. This royal decree is issued to the core and under the powers allocated to the State in articles 149.1.16. Nd, 23. And 25th. Meetings of the Spanish Constitution, in terms of bases and general coordination of health protection of the environment m bases of the regime and mining and energy, respectively.
Second final provision. Entry into force. This Royal Decree shall enter into force on the date of its publication in the Official Gazette of the State ".
The indices of acoustic insulation to airborne sound insulation are:
The constructive elements of internal separation, as well as the facades, decks, medianerías and the soil in contact with the outside air that make up each site of a building should have
in conjunction with the adjacent construction elements, such characteristics to be met:
A) IN THE ENCLOSURES PROTEJAMOS
I) Protection against noise generated in the same unit for use:
The overall noise reduction, weighted, RA, the wall would not be less than 33dBA.
Ii) Protection against noise from other units in use:
Acoustic insulation to airborne sound, DNT, A, between a safe and any other building, vertically or horizontally adjacent to it, belonging to a unit of use, shall not be less than 50 dBA.
III) Protection against noise from common areas:
Acoustic insulation to airborne sound, DNT, A, between a safe and a common area, vertically or horizontally adjacent to it, provided they do not share windows or doors, shall not be less than 50 dBA. When the share itself, the total noise reduction, RA, of these, shall not be less than 30 dBA and the total noise reduction, RA, of the wall shall not be less than 50 dBA.
IV) Protection from noise from the premises of facilities and venues of activity:
Acoustic insulation to airborne sound, DNT, A, between a safe campus and a facility or a site of activity, either vertically or horizontally adjacent to it, shall not be less than 55 dBA.
V) Protection against noise from outside:
Acoustic insulation to airborne sound, D2m, nT, Atr, and safe from the outside is not lower than the values shown in Table 2.1, depending on the use of the building and the values of the noise index day, Ld, defined in Annex I of Royal Decree 1513/2005 of December 16, the area where the building. This ranges from 30 to 47 dBA.
B) IN THE USUAL ENCLOSURES
I) Protection against noise generated in the same unit for use:
The overall noise reduction, weighted, RA, of the enclosure shall not be less than 33 dBA.
Ii) Protection against noise from other units in use:
Acoustic insulation to airborne sound, DNT, A, between a compound and any habitable habitable enclosure vertically or horizontally adjacent to it, which belongs to a different use shall not be less than 45 dBA.
C) in normal and safe ENCLOSURES Adjacent to buildings
Acoustic insulation to airborne sound (D2m, nT, Atr) from each of the shell of a medianería between two buildings shall not be less than 40 dBA, or alternatively at the airborne sound insulation (DNT, A) for the whole of the two enclosures shall not be less than 50 dBA
